These terms apply to your use of Butter My Toast at buttermytoast.com (the “site”), run by Butter My Toast (“we”, “us”). By using the site, you agree to them. If you don’t agree, please don’t use the site.

1. The site

Butter My Toast is a free photo booth that runs in your web browser. It applies effects to your camera picture on your own device and lets you save or share the photos you take. We may change, pause or stop the site, or any part of it, at any time.

You own the photos you take. They’re created on your device and we never receive them, so you’re responsible for how you store, use and share them. Our privacy policy explains this in more detail.

The site’s design, code, effects, text and graphics belong to us or our licensors and are protected by intellectual property laws. You may use the site for your own personal, non-commercial fun. The photos you make with it are yours to use however you like, within these terms. Please don’t copy or resell the site itself.

5. No warranty

The site is provided “as is” and “as available”, free of charge, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the site will always be available, work on every device or browser, or be free of errors.

6. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, photos, profits or goodwill, arising from your use of the site. Our total liability for any claim relating to the site is limited to US $50. Some places don’t allow these limits, so they may not all apply to you.

7. Indemnity

If you use the site in breach of these terms or the law, and someone makes a claim against us because of it, you agree to cover the reasonable costs of that claim.

8. Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in California, unless the law where you live requires otherwise.

We may update these terms from time to time. We’ll post the new version here and update the effective date at the top. If you keep using the site after a change, the new terms apply.
